I Prerequisites and conditions for using the e-shop
1. These general terms and conditions of the e-shop of OÜ Maxi IT (hereinafter referred to as Maxi IT or the seller) (hereinafter referred to as the terms and conditions) apply to all persons (hereinafter referred to as the buyer or the consumer) who use the Maxi IT e-shop, order goods from the e-shop and have concluded a contract for the purchase and sale of goods (hereinafter referred to as the sales contract).
2. In the event of a conflict between the provisions of the terms and conditions and those of the sales contract, the sales contract shall be the basis for determining priority.
3. In matters not covered by the Terms (including, but not limited to, the modification of the Terms), the parties shall be governed by the provisions of the Customer Agreement.
4. In Maxi IT e-shop it is only possible to buy goods that have a link “Add to cart”. Goods marked as “Out of stock” or “On order” are out of stock. The price and availability of goods are subject to change without notice. If the buyer has placed an order before the price of the goods has been changed, the price valid at the time of the order will apply.
5. Maxi IT has the right to withdraw from the sales contract concluded through the e-shop without sanctions and to not deliver the ordered goods or provide the service in the following cases: – the goods have run out of stock; – the price or characteristics of the goods are incorrectly displayed in the online shop due to a system error; – if the buyer does not meet the conditions set by Maxi IT.
If Maxi IT is not able to fulfil the order, the buyer will be contacted and the amount paid will be refunded if the buyer has paid in advance for the goods.
6. You can change the contents of your shopping cart on the Shopping Cart/Order page. Once the delivery address has been entered and the order has been confirmed, the contents of the shopping cart can no longer be changed and the cart will be emptied of the goods. If the buyer cancels the order after placing the order, the goods will have to be re-selected in the shopping cart. After adding a product to the “Shopping Cart”, you can continue browsing other products or place an order.
7. You can pay for the goods in the e-shop on the basis of an invoice provided by Maxi IT by bank transfer. You can also pay for the goods on the spot at Lääneringtee 39, Tartu (Lõunakeskus).
8. Orders placed in the e-shop will be checked the same day and the buyer will be contacted no later than the next working day.
9. The goods will be delivered to the delivery address entered in the order at the agreed time. The goods are delivered only to the buyer. Goods are delivered to a third party if there is a power of attorney, including if the buyer has specified a third party as the recipient of the goods in the order. Maxi IT may authorise third parties to deliver the goods, including the use of courier services.
II Withdrawal from the sales contract and return of goods
10. The consumer has the right to withdraw from the sales contract within 14 days from the date of delivery of the goods. Purchased goods cannot be returned if they have been made to meet the consumer’s personal needs or if they have been manufactured in accordance with the conditions indicated by the consumer. Audio and video recordings (videos, CDs, etc.) or computer software with an open envelope cannot be returned. Returned goods must not have been used and must be in their original packaging. If the goods have been bought in a promotion where a product has been added to the goods, the buyer must return the whole set.
11. In the event of withdrawal from the sales contract, a statement to that effect must be sent to the following e-mail address. epood@maxi.ee. The declaration must include the following information: the goods to be returned, the order number and the bank account to which the money should be credited. The amount paid for the goods (including the postage if it was paid by the Consumer) will be refunded to the consumer’s bank account within 14 days of the notice of withdrawal reaching the seller. The direct costs of returning the goods must be borne by the Consumer.
12.If, after the goods have been returned, the seller’s inspection of the condition of the goods reveals that the goods to be returned have deteriorated, the buyer must compensate the seller for the depreciation of the goods. The seller may submit a claim to this effect within one month of the return of the goods at the latest. The buyer is obliged to compensate for the value of the goods if the goods have been altered, damaged, encumbered with third party rights, etc. by the buyer.
III Liability and dispute settlement
13. The consumer has the right to lodge a complaint and return the goods in case of non-conformity with the terms of the contract (not corresponding to the sample offered or defective). In the case of defective goods, the consumer has the right to complain to the seller within two years from the date of delivery. The complaint must be lodged immediately, but no later than two months after the discovery of the defect. In order to facilitate the resolution of any subsequent problems, the consumer must keep the purchase documents (invoice, contract, etc.) proving that the goods have been purchased from the Maxi IT e-shop. Without proof of sale, the seller/service provider may fail to solve the problem.
14. Complaints about goods purchased from the e-shop should be sent to: OÜ Maxi IT, Lääneringtee 39, 50501 Tartu, Estonia or by e-mail: epood@maxi.ee. When returning the goods, they must be brought to Maxi IT shop at Lääneringtee 39, Tartu.
15. In the case of defective goods, the consumer has the right to: 1) First, demand that the goods be repaired or replaced free of charge. 2) Demand a reduction in the purchase price or withdraw from the contract if: – the seller is unable to repair or replace the goods, – repair fails, – the seller has not remedied the lack of conformity within a reasonable time, – the repair or replacement has caused the consumer unreasonable inconvenience. inconvenience.
The Seller shall not be liable for defects in the goods caused by improper use, maintenance or damage.
